مہلک حادثات میں متوفی کے وارثین کو مالی معاوضہ( Damages)پر عدالت کا اہم ترین فیصلہ:
یہ فیصلہ پاکستانی عدالتی نظام میں ایک اہم سنگ میل کی حیثیت رکھتا ہے، خاص طور پر Fatal Accident Act 1855 کے تحت معاوضے کے تعین اور مالک اور ملازم کی ذمہ داریوں کے تعین کے حوالے سے۔
ذیل میں اس فیصلے کے کلیدی پہلوؤں کا جائزہ پیش کیا جاتا ہے:
1. قانونی بنیاد اور مقدمے کا پس منظر
- یہ مقدمہ Fatal Accident Act 1855 کے تحت دائر کیا گیا، جس کا مقصد لاپرواہی سے ہونے والے مہلک حادثات میں متوفی کے قانونی وارثین کو مالی معاوضہ فراہم کرنا ہے۔
- واقعہ 13 اکتوبر 2018 کو کراچی کے ہب ریور روڈ پر پیش آیا، جہاں ڈمپر ٹرک کے ڈرائیور (ڈیفنڈنٹ نمبر 1) کی لاپروائی سے دو افراد (محمد سرفراز، 33 سال؛ ابو بکر، 13 سال) ہلاک ہوئے۔
- ڈرائیور کے پاس صرف LTV لائسنس تھا، جو بھاری گاڑی چلانے کے لیے ناکافی تھا۔(تحریر: قانون دان ٹیم) گاڑی کا مالک (ڈیفنڈنٹ نمبر 2) بھی ذمہ دار ٹھہرایا گیا، کیونکہ اُس نے ڈرائیور کو غیرموزوں لائسنس کے باوجود گاڑی چلانے کی اجازت دی۔
2. معاوضے کا تعین
- محمد سرفراز (33 سال):
- ماہانہ آمدنی: 50,000 روپے۔
- متوقع عمر (65 سال تک): 32 سال (384 ماہ)۔
- کل معاوضہ: 19,200,000 روپے۔
- ابو بکر (13 سال):
- ممکنہ آمدنی (بڑھتی عمر کے ساتھ): 50,000 روپے ماہانہ۔
- متوقع کام کرنے کی مدت (65 سال تک): 47 سال (564 ماہ)۔
- کل معاوضہ: **28,200,000 روپے۔
- دونوں کا کل معاوضہ:47,400,000 روپے(سود سمیت 15% سالانہ اضافہ)۔
3. مشترکہ اور انفرادی ذمہ داری (Composite Negligence):
- عدالت نے National Logistic Cell vs. Irfan Khan کے کیس کا حوالہ دیتے ہوئے واضح کیا کہ جب دو یا زیادہ فریقوں کی مشترکہ لاپروائی سے نقصان ہو، تو ہر فریق مشترکہ اور انفرادی طور پر ذمہ دار ہوتا ہے۔
- مالک (ڈیفنڈنٹ نمبر 2) کو بھی ذمہ دار ٹھہرایا گیا، کیونکہ اُس نے ڈرائیور کو غیرمناسب لائسنس کے ساتھ گاڑی چلانے دی، جو Pakistan Railways vs. Abdul Haq کے فیصلے کے مطابق "مالک کی ذمہ داری" ہے۔

- احتساب کا فروغ: عدالت نے زور دیا کہ معاوضے کا مقصد نہ صرف متاثرین کو انصاف دلانا ہے، بلکہ معاشرے میں لاپروائی کرنے والوں کے لیے ڈیٹرنس (Deterrence) بھی پیدا کرنا ہے۔
- وارثین کے حقوق: شریعت کے اصولوں کے مطابق معاوضہ وارثین میں تقسیم کیا جائے گا، جو قانونی اور اخلاقی دونوں اعتبار سے اہم ہے۔
- عدالتی عمل کی رفتار: ڈیفنڈنٹس کی طرف سے تاخیر اور غیرحاضری کے باوجود، عدالت نے معاملے کو بروقت نمٹا کر **انصاف تک رسائی کو یقینی بنایا۔ اور دعویٰ دائر کرنے کے وقت سے سود سمیت معاوضہ دینے کا پابند کیا۔

• Non-Cognizable Offence (Punishment: 1 year imprisonment).
• JoP transfers the case to a magistrate under Section 155 CrPC.
