It could be openly discussed as an issue of definitions. It's been in court many times, most famously with the "I know it when I see it" line, but nobody has been able to give a good definition. A picture of a person in a swimsuit posing provocatively on a public beach? Most would say No, but some might say Yes. And therein lies the real problem.
