In my country the teacher has a sworn legal 'in loco parentis' duty of care. Doing or tolerating this behaviour would be actionable and result in the teacher being fired.
If a student were continually falling asleep in my class like this I would have been insisting the cause be investigated asap; there are a number of critical medical reasons for this 'rude behaviour' which should be excluded for example.
