tvl are now ignoring the wora in Scotland stating it does not apply in Scotland,tis may be true,but took them long enough to work this out,,,however,,,the Scottish land reform act does apply on private property like gardens etc leading to a dwelling etc,,you can ask person to leave and instruct them no to come back over the boundary,seem you are well within your right to do this under the act,,,there is no trespass law in Scotland ,however you can take civil action against anyone coming onto your land under civil trespass,this is why police dont like to get involved as it a civil matter,police could be called,but they would be looking at breach of the peace in Scotland if a complaint was made against tvl/capata/g4s etc...you could also impose fees,your land your rules,probably if a fee notice was on display at the boundary for access,network rail do this for crossing there land,and you can use the small claims court to pursuer the fee,s,,,,,i thinks a letter from a lawyer to tvl reminding them of the legal stance would be enough to put them off....SCOTTISH LAND REFORM ACT,,your land,your rules.
